Does Child Support Count as Income? Taxes, Loans & Benefits

📚 TL;DR (Quick Summary)

For federal taxes: NO — child support you receive is not taxable income, and the payer cannot deduct it. For mortgages/loans: YES, lenders can count reliably received support (usually 6+ months history, continuing 3+ years) as qualifying income. For public benefits: it depends — SNAP counts it, Medicaid/CHIP rules vary. For calculating a NEW Texas child support obligation: support you receive for other children is NOT income, but it can matter through offsets and multi-family adjustments.

1Taxes: Neither Income nor Deduction

The IRS treats child support as a personal obligation, not income. The receiving parent doesn't report it; the paying parent can't deduct it. (Contrast: pre-2019 alimony was taxable/deductible; post-2018 spousal maintenance follows the same non-taxable rule as child support.) The child tax credit follows the dependency rules in your decree — not who receives support — so make sure your decree says who claims the kids.

2Loans, Rent, Benefits, and New Support Orders

  • Mortgages (FHA/conventional): counted if documented — decree plus 6+ months of receipts, expected to continue 3 years
  • Apartments: most landlords count it toward income requirements with proof of consistent payment (OAG payment records work well)
  • SNAP: counted as unearned income for the household; TANF: mostly assigned to the state while receiving benefits
  • New Texas support calculations: support received for other kids is excluded from your "net resources" (§154.062), and payers get a multi-family reduction for other children they legally support

?Frequently Asked Questions

Do I pay taxes on child support I receive in Texas?+
No. Child support is never taxable to the recipient and never deductible for the payer under federal law.
Can child support help me qualify for a mortgage?+
Yes, if documented: a court order plus 6–12 months of on-time payment history, with support expected to continue at least 3 years. OAG registry printouts are ideal proof.
Who claims the children on taxes after divorce?+
Whatever the decree says — typically the custodial parent, or alternating years. If the decree is silent, IRS rules give it to the parent with more overnights.
Does the support I receive affect what my new ex will pay?+
No — support received for children of another relationship is excluded from net resources when calculating a new Texas obligation.
