Child Support FAQs - Odessa, Texas

Common questions about child support in Texas answered by our experienced attorneys.

How much is child support in Texas?

Guideline support is a percentage of the paying parent's net resources: 20% for 1 child, 25% for 2, 30% for 3, up to 40%+ for 5 or more — applied to the first $9,200/month of net resources. The child's health and dental insurance are ordered on top.

What counts as income for child support?

Nearly everything: wages, overtime, bonuses, commissions, self-employment, rental income, even unemployment benefits. For fluctuating oilfield income, Ector and Midland County courts commonly average 12–24 months rather than using a single month.

When does child support end in Texas?

At 18 or high school graduation, whichever is later — and it can continue indefinitely for a disabled child. Arrears never expire: unpaid support survives the child turning 18 and even bankruptcy, accruing 6% interest.

What happens if child support isn't paid?

Texas enforces aggressively: wage withholding, license suspension, tax refund intercepts, liens, passport denial, and contempt — up to 6 months jail per missed payment. If you can't pay, file a modification immediately; reductions are never retroactive.

Can child support be changed?

Yes — if circumstances materially changed or three years have passed and the guideline amount differs by 20% or $100 from the current order. Job loss, new children, and custody changes are common grounds. The change only applies from the filing date.

Excellent attorney! Made the process smooth/painless and always had my best interest in mind. Did not make me feel like a client but more like a family. Would recommend to anyone looking for an attorney for child support or divorce. Thank you, Mr. Robles for representing me and my baby boy!
